Disciplinary Procedure and Oversight of KCA Members' Activities

These regulations define the procedure for monitoring compliance by KCA members with the Charter, the Code of Professional Conduct, and the standards and rules of practice of the Chamber, as well as the procedure for reviewing disciplinary cases and appealing decisions.


1. Oversight of KCA Members' Activities

  1. The KCA carries out systematic oversight of compliance by its members with mandatory professional requirements.
  2. Oversight is carried out on the basis of:
    • analysis of the regular information and reports submitted by members (including continuing professional development (CPD) logs);
    • complaints and official appeals from clients of actuarial services, employers, government authorities (including the regulator, AРРФР), or other members of the Chamber;
    • the results of scheduled and unscheduled quality reviews of actuarial opinions.

2. Disciplinary Measures

In the event that violations of the Charter, the standards of practice, or the Code of Ethics are identified, the following disciplinary measures may be applied to members of the Chamber (depending on the severity of the violation):

  1. Order to mandatorily remedy violations — establishes specific deadlines for correcting methodological or procedural errors.
  2. Warning — issued in writing; may be either confidential or public (with publication on the Chamber's website).
  3. Suspension of professional status (certificate) — a temporary prohibition on signing official actuarial opinions and using KCA statuses (for a period until the violations are remedied or re-certification is completed).
  4. Expulsion from KCA membership — the ultimate measure, entailing the full revocation of professional status and removal from the Chamber's register of actuaries.

3. Procedure for Reviewing Cases and the Right to a Defence

  • Reviewing body: All disciplinary cases are reviewed by a specialized body — the KCA Committee on Professional Ethics and Discipline.
  • Decision-making: A decision to suspend professional status or to expel a member from the KCA is taken by a qualified majority — no fewer than two-thirds of the votes of the full composition of the Committee.
  • Right to a defence: In the course of disciplinary proceedings, a KCA member is guaranteed the right:
    • to be notified in a timely manner of the substance of the claims made;
    • to review all materials of the inquiry;
    • to submit written explanations and evidence;
    • to attend the Committee's meetings in person and to be heard (independently or through a representative).

4. Procedure for Appealing Decisions

  1. Any decision of the KCA Committee on Professional Ethics and Discipline may be appealed to the collegial governing body of the Chamber — the Board — within 30 calendar days from the date of receipt of a copy of the decision.
  2. The filing of an appeal suspends the enforcement of disciplinary measures until a decision is rendered by the Board (except in cases where delay poses a direct threat to the public interest or to the stability of the financial market).
  3. KCA members also retain the unconditional right to appeal decisions of the Chamber's bodies to the judicial authorities of the Republic of Kazakhstan.
