In accordance with the laws of the Republic of Kazakhstan "On insurance activities", "On compulsory insurance of civil liability of private notaries", "On compulsory insurance civil liability of audit organizations", "On compulsory insurance civil liability of the carrier to passengers", "On compulsory insurance civil liability of vehicle owners", "On compulsory tourist insurance", "On compulsory insurance civil liability of owners of objects whose activities are associated with the danger of causing harm to third parties", "On compulsory environmental insurance" Board of the National Bank of the Republic of Kazakhstan RESOLVES:

1. Install:

1. Requirements for the content and procedure for issuing insurance policies in accordance with Appendix 1 to this resolution;

2. excluded by the resolution of the Board of the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market dated December 23, 2020 No. 127 (shall be enforced upon the expiration of ten calendar days after the day of its first official publication). 2. To recognize as invalid the regulatory legal acts of the Republic of Kazakhstan, as well as the structural elements of some regulatory legal acts of the Republic of Kazakhstan according to the list in accordance with Appendix 3 to this resolution.

3. The Department for Regulation of Non-Bank Financial Organizations (A.M. Kosherbaeva), in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

1. together with the Legal Department (Sarsenova N.V.) state registration of this resolution with the Ministry of Justice of the Republic of Kazakhstan;

2. within ten calendar days from the date of state registration of this resolution, its sending in the Kazakh and Russian languages ​​to the Republican State Enterprise with the right of economic management "Republican Center for Legal Information" for official publication and inclusion in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

3. placement of this resolution on the official Internet resource of the National Bank of the Republic of Kazakhstan after its official publication;

4. within ten working days after the state registration of this resolution, submission to the Legal Department of information on the implementation of the measures provided for in subparagraphs 2), 3) of this paragraph and paragraph 4 of this resolution.

4. The Department for the Protection of the Rights of Consumers of Financial Services and External Communications (Terentyev A.L.) ensure that within ten calendar days after the state registration of this resolution, a copy of it is sent for official publication in periodicals.

5. Control over the implementation of this resolution shall be assigned to the Deputy Chairman of the National Bank of the Republic of Kazakhstan Zh.B. Kurmanov.

6. This resolution comes into force on January 1, 2019 and is subject to official publication.

Requirements for the content and procedure for issuing insurance policies

1. These Requirements for the content and procedure for issuing an insurance policy (hereinafter referred to as the Requirements) were developed in accordance with the laws of the Republic of Kazakhstan “On insurance activities”, “On mandatory insurance civil liability of private notaries", "On compulsory insurance civil liability of audit organizations", "On compulsory insurance civil liability of the carrier to passengers", "On compulsory insurance civil liability of vehicle owners", "On compulsory insurance tourist" (hereinafter referred to as the Law on Compulsory Tourist Insurance), "On Compulsory Insurance of civil liability of owners of objects whose activities are associated with the danger of causing harm to third parties", "On compulsory environmental insurance" and establish requirements for the content and procedure for issuing insurance policies.

For the purposes of the Requirements, the following concept is used:

insurer - an insurance organization, a branch of a non-resident insurance organization of the Republic of Kazakhstan.

2. The insurance policy contains the following information:

1. name, location, telephone number and bank details of the insurer;

2. last name, first name, patronymic (if any), individual identification number, economic sector code, sign of residence (resident of the Republic of Kazakhstan or non-resident of the Republic of Kazakhstan), legal address and (or) place of residence of the policyholder (for individuals);

3. name, business identification number, economic sector code, sign of residence (resident of the Republic of Kazakhstan or non-resident of the Republic of Kazakhstan), location and actual address, bank details of the policyholder (for legal entities);

4. last name, first name, patronymic (if any), telephone number, individual identification number of the insurance agent (if he is an individual resident of the Republic of Kazakhstan) or name, location and actual address, telephone number and business identification number of the insurance agent (if he is a legal entity resident of the Republic of Kazakhstan);

5. indication of the insurance object;

6. indication of the insured event;

7. the amount of the insured amount, the type of currency, the procedure and timing of the insurance payment;

8. the amount of the insurance premium (insurance premium if payment is made in installments), the total amount of the insurance premium and the amount of the insurance premium taking into account the benefits (if any) under compulsory insurance contracts for civil liability of vehicle owners, the total amount of the insurance premium and the amount of the insurance premium taking into account the discount provided by the insurer (if any), the type of currency, the procedure and timing of payment of the insurance premium;

9. an indication of the presence or absence of commission payable to the insurance agent;

10. date of conclusion and validity period of the insurance policy;

11. indication of the identification number, sign of residence and economic sector of the insured (beneficiary), if he is not the insured under the insurance policy, if the insured (beneficiary) is indicated in the insurance policy;

12. insurance policy number (if the insurance policy is issued in paper form on the insurer’s letterhead) or a unique insurance policy number assigned by the organization for the formation and maintenance of the database (if the insurance policy is issued in electronic form);

13. deadlines for notifying the policyholder or the insured about missing documents necessary to make an insurance payment;

14. type of economic activity (for legal entities);

15. indication of the territory of validity of the insurance policy;

16. signature of the insurer (if the insurance policy is issued in paper form on the insurer’s letterhead);

17. information in accordance with the legislation of the Republic of Kazakhstan on insurance and insurance activities.

The economic sector code is indicated in accordance with the Rules for the application of economic sector codes and the purpose of payments, approved by resolution of the Board of the National Bank of the Republic of Kazakhstan dated August 31, 2016 No. 203, registered in the Register of State Registration of Normative Legal Acts under No. 14365, and the Instructions for submission by second-tier banks, the Development Bank of Kazakhstan, branches of non-resident banks of the Republic of Kazakhstan, branches of non-resident insurance (reinsurance) organizations of the Republic of Kazakhstan and mortgage organizations to the National Bank of the Republic of Kazakhstan of information to form an overview of the financial sector, approved by Resolution of the Board of the National Bank of the Republic of Kazakhstan dated June 29, 2018 No. 139, registered in the Register of State Registration of Normative Legal Acts under No. 17274.

The type of economic activity is indicated in accordance with Appendix 38 to the Resolution of the Board of the National Bank of the Republic of Kazakhstan dated December 31, 2019 No. 275 "On approval of the list, forms, deadlines for submitting reports by an insurance (reinsurance) organization and an insurance broker and the Rules for its submission", registered in the Register of State Registration of Normative Legal Acts under No. 19927.

3. Information about the policyholder and the insured contained in the insurance policy corresponds to the information specified in the policyholder’s application, on the basis of which the insurance policy is issued.

4. If an insurance policy is issued in paper form on the insurer’s letterhead, a description of the rights and obligations of the parties is set out on the back of the insurance policy or attached to it.

5. The insurance policy for compulsory insurance of a tourist, in addition to the information specified in paragraph 2 of the Requirements, contains the name, location, Internet resource, telephone and fax numbers, email address of the assistance company of the insurer, last name, first name, patronymic (if any), date of birth, place of residence of the insured, information about the compulsory insurance program of the country of residence of the tourist, a note on familiarization of the policyholder (insured) with the conditions chosen by the policyholder (insured) insurance programs.

6. To confirm the conclusion of an insurance policy for compulsory tourist insurance, the insurer issues an insurance certificate to the policyholder in electronic form, indicating the availability of valid insurance coverage in relation to the insured.

At the request of the insured, the insurance certificate is issued in paper form on the insurer's letterhead.

Insurance certificate in addition to the information specified in subparagraphs 1), 2), 3), 6), 8), 10), 11), 12), 15) and 16) of paragraph 2 and paragraph 5 of the requirements, contains the procedure for the actions of the insured upon the occurrence of an insured event and the insurance program.

An indication of the object of insurance, the maximum amount of liability of the insurer (sum insured) and types of expenses to be reimbursed, a description of the rights and obligations of the parties, the procedure and timing of insurance payment, as well as other insurance conditions established by the Law on Compulsory Tourist Insurance are attached to the insurance certificate.

The insurance policy for compulsory tourist insurance and the insurance certificate are filled out taking into account the requirements stipulated by international treaties and the legislation of the country (place) of the insured’s temporary stay.

6-1. An insurance policy for compulsory civil liability insurance of vehicle owners, in addition to the information specified in clause 2 of the Requirements, contains information about the driving experience of the policyholder and the insured (insured) (more than two years, less than two years) and the date of release of the vehicle (vehicles).

7. If the insurance policy is issued by a branch of the insurer, then the insurance policy contains the name, location and telephone number of the insurer's branch, last name, first name, patronymic (if any) of the head of the branch.

8. Insurance policies under compulsory insurance contracts, the types, conditions and procedure of which are established by separate legislative acts of the Republic of Kazakhstan regulating compulsory types of insurance, are issued in electronic form and are not subject to printing on the form of the insurance policy.

Insurance policies under imputed and voluntary insurance contracts are drawn up in paper form on the insurer’s letterhead and (or) in electronic form.\

9. The text of the insurance policy is presented in Kazakh and Russian, the insurance policy for compulsory tourist insurance, the insurance certificate - in Kazakh, Russian and English.

The text of the insurance policy and certificate is printed in Times New Roman font, size no less than nine, with regular letter spacing, single line spacing and paragraph indentation.

The availability of an insurance policy generated in electronic form is ensured for viewing by the policyholder (the insured, the beneficiary), as well as for downloading and saving it.

The text of the insurance policy and insurance certificate are subject to interpretation in accordance with the literal meaning of their verbal expression. If special insurance terminology is used in the text, its full and unambiguous interpretation is given.

10. An insurance policy drawn up in paper form on the insurer’s letterhead is signed by the insurance agent, if there is appropriate authority in the agreement concluded between the insurer and the insurance agent.

11. Amendments and erasures when filling out an insurance policy or insurance certificate, drawn up in paper form on the insurer’s letterhead, are not allowed.

12. In the event of loss of an insurance policy or insurance certificate issued in paper form on the insurer’s letterhead, the insurer, at the request of the policyholder or the insured, issues a duplicate, which has the same legal force as the original, with the inscription “duplicate” in the upper right corner and indicating the date of initial issue of the insurance policy or insurance certificate.
